对于业主共有车位必须明确且也可以登记为业主共有。目前很多开发商将业主共有地下车位偷卖。而不动产登记条例规定了业主共有不登记造成的漏洞。且由于土地使用权的无法分割以及建设成本是否分摊能判断是否归全体业主还是建设单位，这必须明确以及细化。

不占容积率的地下空间形成的车位属于业主共有。不能单独登记专有产权。否则违反了民法典346条，会侵害已设立土地使用权的用益物权。

不占容积率的地下空间形成的车位属于业主共有。不能单独登记专有产权。

建筑单位必须有完整的单独立项，单独投资，未列入小区总体建设成本打入房价的可以登记专有产权，否则不能登记。
