padding: 0px; max-width: 100%; box-sizing: border-box !important; word-wrap: break-word !important; font-size: 14px; font-family: PingFangSC-Light; color: rgb(41, 39, 39);"> 法院审理认为，男女双方在订婚时，男方给予女方一定数额的彩礼，符合农村的风俗习惯。彩礼给付，从法律意义上可认定为“以结婚为目的的附条件的赠与行为”。我国倡导建立以感情为基础的文明、自由婚姻，并禁止包办、买卖婚姻和其他干涉婚姻自由的行为，禁止借婚姻索取财物。根据我国法律规定:“当事人请求返还按照习俗给付的彩礼的，如果查明属于双方未办理结婚登记手续的，人民法院应当予以支持。”本案中，双方订立婚约后又分手，宋某给付的彩礼应当返还。至于具体数额，鉴于黄、宋已共同生活八个月之久，彩礼钱部分用于日常开销，部分用于置办婚礼、购买陪嫁品等，故黄某返还3万元及金首饰，符合酌情返还的合理范围，故此，对宋某父子提出的诉求不予支持，驳回了其诉讼请求。</span></p><p><br/></p><link rel="stylesheet" href="http://bbs.jjxw.cn/source/plugin/wcn_editor/public/wcn_editor_fit.css?v134_yF3" id="wcn_editor_css"/> 支持德安人民法院判决，驳回有理！女方更亏！
