white-space: normal; background-color: rgb(255, 255, 255); text-align: justify;">据居民反映，小区内多栋居民楼一楼有人占用绿地建院子搭建玻璃房顶的现象。而且，在一些居民楼顶还有私自搭建的阳光房。绿地属于全体业主所有，被人占用明显侵害了业主的公共权益。居民们说，这类现象在小区多有发生，自小区建成以来，每年都会出现，但物业管理处虽然下发了整改通知书，但却没有彻底解决这类违章现象。</p><p style="box-sizing: border-box; color: rgb(51, 51, 51); white-space: normal; background-color: rgb(255, 255, 255); text-align: justify;">13日，记者在尚海湾小区看到，3栋至6栋居民楼一楼均出现了以铁栅栏围挡的院落，院落中地面没有绿草，有的还被水泥硬化。在这些院落中，有的搭建了玻璃房顶，下面放置着数量不等的花盆等。有的院落栅栏外还有院墙，在院墙上开门。除这几栋外，13栋和14栋居民楼一楼也有这样的现象。同时，在一些居民楼的顶部出现了阳光房。</p><p style="box-sizing: border-box; white-space: normal; background-color: rgb(255, 255, 255); text-align: justify;">对于居民所反映的这些问题，九江广良物业公司尚海湾物业管理处办公室负责人表示，在小区的多层居民楼一楼，开发商当初建设时附有院子，是赠送给购买一楼房屋的业主的，业主享有使用权，所以业主在院落中搭建，很难说是违章建筑，毕竟是在其院落范围内。同样，在这些多层居民楼的顶层，开发商附赠给顶层住户平台，业主在这样的平台上搭阳光棚，如果没有超范围，也很难界定。这两种情况，因为违章界线模糊，又没有影响到相邻业主的利益，所以虽然下发了整改通知书，执法人员也到了现场，但也没办法作出鉴定。</p><p style="box-sizing: border-box; 二楼都不好晒衣服，物业怎么不管，物业怎么帮助二楼的住户解决晒衣服问题咯？ 又没有影响到相邻业主的利益？？？ 怎么没有影响？ 一楼搭了棚子二楼晒衣服就是有影响的，物业昧着良心说话吗？ 是不是存在一些灰色的利益关系 还是执法不严，说什么难于鉴定都是屁话，平白无故多出一个建筑物不需要规划审批的吗？既然需要不就是违建，扯七扯八干什么！

说的对，只要超出建筑设计图以外的建筑物都是违规的，什么开发商定的，都是屁话，把原有绿化铲除做硬化就是违规，希望城管执法部门能公平执法。
个人认为：院子的面积不在公摊面积范围内的，赠送就合法；反之这种赠送就不受法律保护！
