深夜“炸街”！无证驾驶！改装摩托！九江3名17岁学生被处罚

float: right; margin-top: -4.7em; overflow: hidden;"></section></section></section><p>（来源：瑞昌市公安局交管大队）</p><p><br/></p><link rel="stylesheet" href="http://bbs.jjxw.cn/source/plugin/wcn_editor/public/wcn_editor_fit.css?v134_hez" id="wcn_editor_css"/> 2017年2月18日凌晨3:00多，沈可婷驾驶着自己的汽车在柔佛新山内环公路上行驶，公路上基本没有行人和车辆，山路弯道多。沈可婷速度不快，却突然在一个弯道与一群骑蚊型自行车的少年撞在一起。沈可婷随后报警并留在现场等候警察。事故造成八人死亡，八人受伤，死者年龄最大的不超过16岁，最小的是13岁，全部都是马来西亚本地居民。此案轰动整个马来西亚，获得全国关注。肇事者沈可婷虽然撞死八名少年，却获得许多民众的同情，因为非法改装脚踏车的问题，在马来西亚早已是严重的社会问题。
警方调查发现沈可婷严格遵守交通规则，没有醉酒驾驶，也没有超速行车或不解安全带等违规行为。反观飙车少年们，他们都骑着改装过的微型自行车飞驰，车辆没有刹车，没有车灯，人员没有佩戴安全护具，而且他们还在逆行。由于死伤人数众多，此案一开始就被当地舆论所关注争议，从未停止。事件发生后，沈可婷被指控鲁莽危险驾驶。根据马来西亚法律规定，一旦指控成立沈可婷将面临最高十年的监禁。
经法官综合审定，2019年10月，地方法院一审判决沈可婷无罪，受害一方的家长上诉。2021年2月18日，二审沈可婷再次被判无罪释放，甚至还归还了她的驾照。
对于这样的结果，受害方家长不能接受，多次申请再审，并被法院接受。2022年4月13日，马来西亚新山最高法院法官阿布合卡以鲁莽和危险驾驶罪，判处沈可婷六年监禁，罚款6000令吉且立即执行。高院判决后，沈可婷一方随即选择上诉，最终在2023年4月11日上诉庭三司一致推翻高庭判决，宣判沈可婷鲁莽或危险驾驶，导致他人死亡罪名不成立，无罪释放。
主持该案件的上诉庭法官哈达丽雅对死者家属深表同情，但强调法庭必须依法判案。“这就是法律，不能仅因有人在事故中死亡，就要司机承担所有责任。”
值得一提的是哈达丽雅也是“2017年马来西亚校园霸凌致死案”的上诉法官。2024年7月，六名霸凌者被判绞刑。 管得好 九江市也很多
