line-height: 1.75em;"><span style="color: rgb(255, 0, 0);"><strong>征收范围</strong></span><br/></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(79, 129, 189);"><strong>新三鼎建设项目地块拆迁范围位于五里街道八里村、十里街道黄土岭村，东至浔南安置小区，南至德化路，西至青年路，北至浔南大道（变电站），共征收房屋面积约10万平方米。</strong></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(255, 0, 0);"><strong>征收部门和征收实施单位</strong></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">本项目房屋征收实行委托征收方式。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">1、房屋征收主体：濂溪区人民政府</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">2、房屋征收部门：濂溪区住建局</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">3、委托五里街道办事处、十里街道办事处组织实施房屋征收工作，并与被征收人签订房屋征收补偿协议。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">4、委托九江市濂溪区房地产测绘队承担被征收房屋的结构认定、面积测绘丈量、附属物勘察清点工作。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(255, 0, 0);"><strong>征收期限</strong></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(79, 129, 189);"><strong>自征收补偿安置方案发布之日起180天内完成全部房屋征收任务。</strong></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(255, 0, 0);"><strong>被征收房屋类型和建筑面积的认定办法</strong></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">1.集体土地上被征收房屋的结构和建筑面积，经有关部门确权后，以征收人委托的具有相应资质的测绘部门测绘数据为准。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">2.未经批准擅自搭建，且经认定为违法建筑的不作补偿，一律自行拆除。拒不自行拆除的，由九江市濂溪区有关行政机关依法进行强制拆除，以料抵工。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(255, 0, 0);"><strong>房屋征收补偿方式、标准和计算方法</strong></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(79, 129, 189);"><strong>1.非住宅补偿实行货币补偿和产权调换两种方式。</strong></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">（1）选择货币补偿方式的：</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">以房屋征收决定发布之日为评估时点，被征收房屋有完全产权的（拥有房屋及土地所有权）根据被征收房屋的区位、成新、结构，面积等因素，由依程序选定的评估机构确定最终货币补偿价格；土地租赁户所建合法房屋和地上附着物的实行货币补偿安置，房屋和地上附着物货币补偿价值由选定的评估按被征收房屋和地上附着物重置价格进行评估确定。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">（2）选择产权调换方式的：</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">房屋完全产权人（拥有房屋及土地所有权）选择产权调换的，对被征收非住宅房屋价值和用于产权调换的非住宅房屋价值以房屋征收决定发布之日为评估时点分别评估，按等价值进行产权调换，调换结清之间差价。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">3.其它补偿</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">（1）征收非住宅房屋符合“有合法、有效的营业执照或者其他相关生产经营行政许可手续，且营业执照或其他相关生产经营行政许可手续上载明的营业场所为被征收房屋”条件的，按被征收房屋营业面积评估价值的4%给予一次性停产停业损失补偿（非住宅给予停产停业损失的，不再支付临时安置补助费）。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">（2）被征收房屋装饰装修价值补偿按房地产价格评估机构评估确定。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">（3）附属物补偿按《九江市房屋征收项目附属物补偿标准参照表》执行。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">（4）<span style="color: rgb(0, 176, 80);"><strong>非住宅房屋搬迁费按被征收房屋建筑面积每平方米8元标准计算。</strong></span></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">（5）机器设备、库存拆装搬迁等费用由委托的评估机构进行评估，并按评估确定的标准给予一次性补偿。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">（6）<span style="color: rgb(0, 176, 80);"><strong>非住宅租金损失补偿。营业店面30元/㎡，生产用房20元/㎡，仓库、办公用房12元/㎡的标准，给予6个月租金损失补偿。</strong></span>（被征收人给予租金损失补偿的不再支付临时安置补助费）</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(255, 0, 0);"><strong>补助和奖励办法</strong></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">凡在征收规定的期限内签订征收补偿协议并完成搬迁缴交钥匙的房屋所有人，<span style="color: rgb(192, 80, 77);"><strong>给予每户6000元的搬迁进度奖。</strong></span></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(255, 0, 0);"><strong>补偿款支付方法</strong></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">根据与被征收人签订的征收补偿协议，征收人向被征收人开具领款凭证（银行存折），被征收人凭存折到征收人办理存款业务的金融机构领取补偿款。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(255, 0, 0);"><strong>面积与分户原则</strong></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">房屋面积认定原则。房屋征收部门应当对房屋征收范围内的权属、区位、用途、建筑面积以及土地使用权属等情况组织调查登记，被征收房屋所有权人应当予以配合。调查结果应当在房屋征收范围内向被征收人公布。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">对房屋征收范围内已依法登记的房屋，其性质、用途和建筑面积，应当以不动产（房屋权属）登记证书和不动产（房屋）登记簿为准，不动产登记（房屋权属）证书和不动产（房屋）登记簿记载不一致的，除有证据证明不动产登记（房屋）簿确有错误外，以不动产（房屋）登记簿为准。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">对房屋征收范围内未依法登记的建筑，由被委托的测绘部门进行实地测量建筑面积，房屋征收部门会同房产、国土、建设、规划、执法等部门进行调查认定，对调查认定为合法的建筑或者未超过批准期限的临时建筑，应当予以补偿；对调查认定为违法的建筑或者超过批准期限的临时建筑，不予补偿。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(255, 0, 0);"><strong>房屋征收评估机构选定</strong></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">参照《江西省国有土地上房屋征收与补偿实施办法》第二十一条和《九江市人民政府关于印发九江市中心城区规划区内集体土地上房屋征收与补偿安置实施办法通知》（九府发〔2016〕13号）第十四条的有关办法选定房地产评估机构。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(255, 0, 0);"><strong>法律责任</strong></span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">1.区房屋征收部门、乡镇街道、村（居）委会的工作人员在房屋征收与补偿工作中不履行本规程规定的职责，或者滥用职权、玩忽职守、徇私舞弊的，由区人民政府责令改正，通报批评；造成损失的，依法承担赔偿责任；对直接负责的主管人员和其他直接责任人员，依法给予处分；构成犯罪的，依法追究刑事责任。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">2.采取暴力、威胁等方法阻碍依法进行的房屋征收与补偿工作，构成犯罪的，依法追究刑事责任；构成违反治安管理行为的，依法给予治安管理处罚。</span></p><p style="margin-bottom: 15px; line-height: 1.75em;"><span style="color: rgb(0, 0, 0);">3.贪污、挪用、私分、截留、拖欠征收补偿费用的，责令改正，追回有关款项，限期退还违法所得，对有关责任单位通报批评、给予警告；造成损失的，依法承担赔偿责任；构成犯罪的，依法追究刑事责任。</span></p><p style="margin-bottom: 15px;
