0);">&nbsp;用人单位应当根据女职工的生理特点和所从事工作的职业特点,建立健全女职工劳动保护和安全生产制度,采取措施改善女职工劳动安全卫生条件,对女职工进行劳动安全卫生知识培训,依法开展女职工劳动保护工作。</span></p><p style="margin: 0px;padding: 0px;clear: both;min-height: 1em;max-width: 0);">&nbsp;用人单位应当在与女职工订立劳动合同或者聘用合同时,以书面形式告知本单位属于女职工禁忌从事劳动范围的岗位。</span></p><p style="margin: 0px;padding: 0px;clear: both;min-height: 1em;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;"><span style="margin: 0px;padding: 0px;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;font-size: 18px;color: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;font-size: 18px;color: rgb(0, 0, 0);">&nbsp;用人单位不得在劳动合同或者聘用合同中与女职工约定限制其结婚、生育等合法权益的内容。</span></p><p style="margin: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;font-size: 18px;color: rgb(0, 0, 0);">劳动合同或者聘用合同期满而孕期、产期、哺乳期未满的,劳动合同或者聘用合同应当顺延至孕期、产期、哺乳期期满,但是女职工本人要求解除合同的除外。</span></p><p !important;font-size: 18px;color: rgb(0, 0, 0);">&nbsp;女职工人数达到用人单位职工总人数10%以上的,参加集体合同协商代表中应当有女职工代表。签订的集体合同应当明确女职工劳动保护的内容。未签订集体合同的用人单位,经平等协商,可以与工会依法签订女职工权益保护的专项集体合同。</span></p><p style="margin: 0px;padding: 0px;clear: both;min-height: 1em;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;"><span style="margin: 0px;padding: 0px;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;font-size: 18px;color: rgb(0, 0, 0);">在县级以下区域内,建筑业、采矿业、餐饮服务业等行业可以由工会与企业方面代表依法订立区域性、行业性女职工权益保护专项集体合同。</span></p><p style="margin: 0px;padding: 0px;clear: both;min-height: 1em;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;"><strong style="margin: 0px;padding: 0px;max-width: !important;font-size: 18px;color: rgb(0, 0, 0);">&nbsp;用人单位不得因女职工结婚、怀孕、生育、哺乳对其实施下列行为:</span></p><p style="margin: 0px;padding: 0px;clear: both;min-height: 1em;max-width: 100%;overflow-wrap: break-word 0);">&nbsp;对从事低温、冷水、野外流动、建筑作业和三级以上高处作业、三级以上体力劳动强度作业的女职工,用人单位在其月经期间应当调整安排其他劳动或者安排休息二至三天。在月经期休息期间,工资和福利待遇不变。</span></p><p style="margin: 0px;padding: 0px;clear: both;min-height: 1em;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;"><span style="margin: 0px;padding: 0px;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;font-size: 18px;color: rgb(0, 0, 0);">其他工种的女职工在月经期间坚持劳动有困难的,用人单位应当给予照顾。</span></p><p style="margin: 0px;padding: 0px;clear: both;min-height: 1em;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;"><strong style="margin: 0px;padding: 0px;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;"><span style="margin: 0px;padding: 0px;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;font-size: 18px;color: rgb(0, 0, 0);">第九条</span></strong><span style="margin: 0px;padding: 0);">&nbsp;用人单位应当对在职女职工按照每人每月不低于三十元的标准发放经期护理费或者护理用品,机关事业单位按照现行负担政策列支,企业可以在职工福利费中列支。经期护理费的标准由省人力资源和社会保障部门会同有关部门根据本省经济发展状况和居民生活水平适时作出调整。</span></p><p style="margin: 0px;padding: 0px;clear: 0);">用人单位应当给予孕期女职工下列劳动保护:</span></p><p style="margin: 0px;padding: 0px;clear: both;min-height: 1em;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;"><span style="margin: 0px;padding: 0px;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;font-size: 18px;color: rgb(0, 0, 0);">(一)不安排其从事国家规定的孕期禁忌从事的劳动;</span></p><p 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;font-size: 18px;color: rgb(0, 0, 0);">(二)在孕期不能适应原劳动的,根据医疗机构的证明,用人单位应当予以减轻劳动量;或者经本人提出,为其安排其他能够适应的劳动岗位;</span></p><p style="margin: 0px;padding: 0px;clear: both;min-height: 1em;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;"><span style="margin: 0px;padding: 0px;max-width: 100%;overflow-wrap: break-word !important;box-sizing: border-box !important;font-size: 18px;color: rgb(0, 0, 0);">(三)对怀孕不满三个月且妊娠反应严重,或者怀孕七个月以上的,用人单位不得延长其劳动时间、不安排夜班劳动,并根据其工作性质和劳动强度安排每天不少于半个小时的工间休息时间;有劳动定额的,减轻相应的劳动量;</span></p><p style="margin: 0px;padding: 0px;clear: both;min-height: 1em;max-width:
