2023年8月1日，聂某某（女）与张某某经婚介公司介绍相识。年8月2日，聂某某向张某某出具承诺书，表明与张某某相识后爱上了张某某，经过慎重考虑愿与张某某结婚，自愿到张某某的工作和生活地与张某某一起安心久居生活。8月3日，双方办理结婚登记，张某某给付聂某某彩礼14.8万元。登记结婚当晚，聂某某向婚介公司咨询如何离婚及离婚后彩礼返还和婚介公司服务费支付等事宜。8月10日，双方彻底分开。后聂某某退还张某某彩礼5.7万元。
2024年5月，聂某某以夫妻感情确已破裂且无和好可能为由起诉请求与张某某离婚。张某某同意离婚，但以婚后女方即离家打工，二人实际仅相处2天，只有夫妻之名，无夫妻之实为由，反诉请求聂某某返还剩余彩礼9.1万元。聂某某对张某某的反诉辩称，剩余彩礼向婚介公司交纳服务费10000元，余款因家庭需要已支出，没能力退还。
法院生效裁判认为，双方办理结婚登记后，实际相处时间极为短暂，未形成完整的家庭共同体和稳定的夫妻共同生活状态。根据双方的相处情况，聂某某亦不存在与张某某形成稳定夫妻关系、长期共同生活的主观意愿。聂某某在没有感情基础的情况下向张某某出具承诺书，收取高额彩礼与张某某迅速结婚，登记结婚当晚向婚介公司咨询离婚及彩礼返还事宜，随即离开不与张某某共同生活，与张某某只有夫妻之名，没有夫妻之实，其行为符合借婚姻索取财物的特征，应当从法律上予以明确的否定性评价，以维护公序良俗。判决：准许聂某某与张某某离婚；聂某某退还张某某彩礼9.1万元。
